Warranty Terms and Conditions ( the “Manufacturing Warranty”)
The following definitions in this clause apply in the Manufacturing Warranty:
MKP, Our means: MKP Bikes Pte Ltd
Product means: Electric Bicycles, Electric and Mobility Scooters, Bicycles distributed by MKP.
Good means: In relation to the Product: the motor; the controller; and the battery cell: with the exclusion of ordinary wear and tear of parts or damage to paintwork, or maintenance.
You, Your means: The original purchaser of the Product from an authorized reseller.
|2. Warranty Duration
2.1 For Electric Bicycles;
2.1.1 Sealed Lead Acid Battery Cells / Lithium Battery Cells (contained in the battery box, excluding the box and its parts), 6 months* from warranty start date;
2.1.2 For the motor (excluding the rim and its parts), 6 months* from warranty start date;
2.1.3 For the controller unit (excluding the box), 6 months* from warranty start date.
2.2 For A2B Electric Bicycles;
2.2.1 Lithium Battery Cells (contained in the battery box, excluding the box and its parts), 24 months* from warranty start date;
2.2.2 For the motor (excluding the rim and its parts), 24 months* from warranty start date;
2.2.3 For the controller unit (excluding the box), 24 months* from warranty start date.
|2.3 For Motorised Mobility Scooters;
2.3.1 Sealed Lead Acid Battery Cells / Lithium Battery Cells (contained in the battery box, excluding the box and its parts), 6 months* from warranty start date;
2.3.2 For the motor (excluding the rim and its parts), 12 months* from warranty start date;
2.3.3 For the controller unit (excluding the box), 12 months* from warranty start date;
2.3.4 For the frame (excluding its parts), 12 months* from warranty start date.
2.4 For Electric Scooters;
2.4.1 Sealed Lead Acid Battery Cells / Lithium Battery Cells (contained in the frame, excluding the box and its parts), 6 months* from warranty start date;
|2.4.2 For the motor (excluding the rim and its parts), 6 months* from warranty start date;
2.4.3 For the controller unit (excluding the box), 6 months* from warranty start date.
2.5 For Bicycles;
2.5.1 For the frame (excluding its parts), 12 months* from warranty start date.
*The warranty duration from the warranty start date, unless stated otherwise.
3. WARRANTY TERMS
3.1 MKP Bikes warrants that on delivery of the Product to You and for the Warranty Duration, the Goods shall:
3.1.1 be free from damages caused during design, production and assembly of the Electric Bike;
3.1.2 be of satisfactory quality.
3.2 This Warranty does not apply to any defect in the Product arising from:
3.2.1 fair wear and tear of components;
a) Paint work
b) Rust on metal parts / components
c) Plastic covers
d) Accessories/ Baskets/Rear racks/Mudguards i) Carbon brushes in motor
e) Saddles/cushions/seat upholstery j) Any other components not stated in point 2
f) Tyres and inner tubes
g) Gears / Freewheels
3.2.2 wilful damage, accident or negligence by You or any third party;
3.2.3 any damage of parts due to flood, storm, any water related events and accidents or incidents due to wet weather and other acts of nature;
3.2.4 Your Product having been assembled by someone other than Our Service Centre or authorized Dealer;
3.2.5 damages to paintwork, or maintenance to the Product;
3.2.6 if you use the Product in a way that Our Service Centre does not recommend, including but not limited to, using the Product for commercial activities or in competitive events or training for such activities or events;
3.2.7 Your failure to follow our instructions, including, but not limited to, the User Manual;
3.2.8 any modification, alteration, repair, or from the addition of parts and components not originally installed at Our Service Centre;
3.2.9 if any tamper proof seals at the battery pack and/or the controller box are found to be tampered with or are missing.
3.3 In order for a battery cell to be deemed valid for warranty, the capacity of the battery cells must fall below 60% of its rated capacity and the voltage of the battery does not fall below its minimum required voltage to charge. Our service centre will inspect and test the battery cells before it will be replaced.
3.3.1 with wear and tear, an increase in operating sound from the motor axle/ drive train is expected. It does not constitute a fault. Warranty does not apply in such cases.
3.3.2 If a Product has been repaired or replaced anytime under warranty duration, only the remaining unused portion of the original Manufacturer Warranty shall apply.
4. DEFECTIVE GOODS AND RETURNS
4.1 In the unlikely event that the Good do not conform to the Warranty, please let Our Service Centre know as soon as possible after delivery and/or breakdown by contacting an authorized reseller or Our Service Centre by visiting www.mkpbikes.com; and
4.1.1 the cost of transportation is not covered and such cost shall be borne by You.
4.2 Our Service Centre will request for You to return the Electric Bike together with PROOF OF PURCHASE, WARRANTY REGISTRATION CARD and relevant accessories or keys to Our Service Centre or an authorized reseller that you bought the Product from. Once Our Service Centre has checked that the Good are faulty. MKP will at its sole discretion:
4.2.1 repair or restore the defective Good in a reasonable time as implied by section 12C(2)(a) of the Consumer Protection (Fair Trading) Act, as such that the Good is operational and ready for use by You; or
4.2.2 replace the faulty Good if repair is impossible, but not limited to the original Good;
4.2.3 in the case that the original Good is not available during the Warranty Duration, a compatible part or component will be used so long as the Product is functional.
4.2.4 Do note that you will be expected to wait for up to 12 working days for warranty claims.
5. LIMITATION OF LIABILITY
5.1 Subject to clause 5.2, if either You or MKP fails to comply with this Warranty, neither shall be responsible for any losses that the other suffers as a result, except for those losses which are a foreseeable consequence of the failure to comply with this warranty.
5.2 Neither You nor MKP shall be responsible for losses that result from MKP’s failure to comply with this Warranty including but not limited to, losses that fall into the following categories:
5.2.1 loss of income or revenue,
5.2.2 loss of business;
5.2.3 loss of anticipated savings;
5.2.4 loss of data; or
5.2.5 any waste of time.
